Myle Drivers App – Terms of Use

1. About these Terms
These Terms of Use (the Terms) govern access to and use of the Myle Drivers application, including any web, mobile or progressive web application through which it is made available (the App).
The App is operated by Myle Connect Ltd, trading as Myle Cars, a company registered in Scotland under company number SC743936, with its registered office at 39 Durham Street, Unit 8, Glasgow, Scotland, G41 1BS (Myle, we, us or our).
These Terms apply to:
approved current Myle drivers; and
members of staff or other personnel whom Myle has expressly authorised to use the App.
References to a user or you mean any person accessing or using the App. Provisions which relate specifically to driving, vehicles, rentals, benefits, referrals, payments or driver compliance apply only where relevant to that user.
By selecting “Accept”, creating or activating an account, or continuing to use the App after being shown these Terms, you agree to be bound by them. If you do not agree, you must not use the App.
2. Relationship with other agreements
The App is a facility through which Myle may provide information and services or administer parts of its relationship with drivers and staff. These Terms do not replace any separate agreement, policy or procedure that applies to you, including:
a driver engagement agreement;
a private hire vehicle rental agreement;
an authority concerning deductions or payments;
vehicle-care, accident or incident procedures;
workplace rules or employment terms applicable to authorised staff;
the rules of an individual benefit, reward, referral or prize promotion; or
any requirement imposed by a licensing authority, insurer, operator, public authority or applicable law.
If there is a conflict, the document dealing most specifically with the relevant matter will normally take priority. The specific rules published for a benefit, reward, referral scheme, competition or prize promotion take priority over the general provisions of these Terms for that activity.
Nothing in these Terms, by itself, creates an employment relationship, partnership, agency, entitlement to work, guarantee of bookings or variation of a user’s existing contractual status.
3. Eligibility and access
The App is a private service. It is not available to the general public.
To hold a driver account, you must:
be a current driver approved by Myle;
satisfy any identity, licensing, compliance and security checks required by Myle;
provide accurate and current registration information; and
continue to meet the eligibility requirements applicable to your relationship with Myle.
Staff and other personnel may use the App only where Myle has expressly authorised their access. Access permissions may differ according to role and business need.
An invitation, account, login or ability to view a feature does not guarantee continued eligibility, vehicle availability, work, bookings, payment, rental approval, benefits or participation in a promotion.
You must not allow another person to use your account. You are responsible for activity carried out through your account unless you promptly notify Myle that the account or device may have been compromised.
4. Account security
You must:
keep passwords, verification codes and recovery information confidential;
use a secure device and take reasonable steps to prevent unauthorised access;
complete multi-factor authentication or other security checks when requested;
notify Myle promptly if a device containing the App is lost or stolen;
notify Myle promptly if you believe your account has been accessed without permission; and
sign out of shared devices.
You must not attempt to bypass authentication, access controls, rate limits, audit records or other security measures.
Myle may require a password reset, re-verification, fresh login, additional identity check or removal of a trusted device where reasonably required to protect users, Myle, TL Vehicles Ltd or another person.
5. Purpose and functions of the App
The App may allow authorised users to:
view, submit and manage document requests;
upload documents, vehicle photographs and other evidence;
receive notices, reminders and notifications;
communicate with Myle personnel;
submit accident or incident information;
make referrals;
raise or track payment queries;
view or access benefits;
participate in rewards, prize draws, instant-win or other promotional mechanisms;
view activity or submission history; and
use other operational features introduced by Myle.
Not every function will be available to every user. Features may be introduced, tested, restricted, paused, amended or removed.
6. Availability and reliability
The App is provided on an “as available” basis. Myle will take reasonable steps to operate and maintain it but does not guarantee that:
the App will always be available, uninterrupted or error-free;
notifications or messages will always arrive immediately;
all functions will work on every device, browser or network;
information displayed will always be complete or current; or
a submission will be received merely because it appears to have been uploaded or sent.
The App may be unavailable because of maintenance, updates, faults, internet or mobile-network failure, third-party systems, cyber incidents or circumstances outside Myle’s reasonable control.
Where a matter is urgent, safety-critical or subject to a deadline, you must not rely exclusively on the App. You should use the alternative contact method provided by Myle and obtain confirmation where appropriate.
An App failure does not remove a user’s responsibility to comply with legal, licensing, insurance, contractual, safety or reporting obligations. However, Myle will consider genuine, evidenced technical failures fairly when reviewing an alleged failure to use the App.
7. User engagement and responsibilities
The App is intended to support effective and timely administration. Users are expected to engage reasonably with processes relevant to them.
This may include:
checking the App and notifications at reasonable intervals;
responding to legitimate requests within the stated time;
supplying required documents or photographs;
reviewing and, where required, acknowledging important notices or handovers;
keeping contact, vehicle, licensing and other relevant information current;
providing further information reasonably requested to assess a submission; and
cooperating with compliance, accident, payment, referral, rental or benefit processes.
Repeated or unreasonable failure to engage may result in a feature being restricted or access to the App being suspended or withdrawn. Where the failure also breaches another agreement, policy, licensing obligation or legal duty, it may be handled under that document or process separately.
8. Documents, photographs and submissions
Information submitted through the App must, to the best of your knowledge, be accurate, complete, current and authentic.
You must not submit:
a false, altered, misleading or fraudulently obtained document;
a document or photograph belonging to another person without authority;
unlawful, threatening, abusive, discriminatory, defamatory or indecent material;
malicious code or a file intended to disrupt a system;
unnecessary personal information about another person; or
content that infringes another person’s privacy, confidentiality or intellectual-property rights.
You remain responsible for checking that the correct and complete file has been submitted. A submission receipt, status indicator or automated confirmation only confirms the relevant system activity. It does not mean that Myle has accepted the document as valid, approved compliance, accepted liability or waived any requirement.
Myle may inspect, verify, reject or request replacement of any submission. Where reasonably necessary, Myle may compare information with its records, the records of TL Vehicles Ltd, issuing bodies, insurers, licensing authorities, service providers or other lawful sources.
Original documents should be retained where they may be required for verification.
9. Communications and notifications
The App may be used to send operational messages, document requests, compliance reminders, benefit information, handovers, payment updates and other notices.
You are responsible for keeping your contact details and notification settings current. Disabling device notifications does not prevent information from being made available within the App and does not necessarily remove an obligation to respond.
Myle will not treat a push-notification delivery indicator as conclusive proof that a user has read or understood a notice. Where acknowledgement is important, the App may ask the user to open, confirm, acknowledge or respond to the item.
The App is not an emergency service. It must not be used as the only method of seeking urgent medical, police, fire or roadside assistance.
10. Accidents, incidents and safeguarding
An accident or incident report submitted through the App does not replace the need to:
call emergency services where required;
comply with road-traffic law;
report the matter to an insurer, vehicle owner, licensing authority or other body where required;
follow Myle’s or TL Vehicles Ltd’s accident and incident procedure; or
take reasonable steps to protect people and property.
You must provide accurate information and preserve relevant evidence. Myle may share accident, incident, safety or safeguarding information where reasonably necessary with TL Vehicles Ltd, insurers, claims handlers, legal advisers, licensing bodies, emergency services, law-enforcement authorities, local authorities or other appropriate organisations, subject to applicable law.
11. Payments and financial queries
Information displayed in the App about payments, deductions, balances, rewards or referrals may be provisional and may depend on information received from other systems.
The App does not replace an invoice, remittance advice, formal account statement, rental agreement, deduction authority or other governing financial record. If there is a discrepancy, Myle may investigate and correct the display or underlying record as appropriate.
Submitting a payment query does not suspend a payment obligation, rental charge, authorised deduction or contractual deadline unless Myle or TL Vehicles Ltd confirms otherwise in writing.
12. Benefits and offers
Benefits made available through the App are discretionary unless the specific benefit terms expressly state otherwise. Access to the App does not create an entitlement to receive any particular benefit.
Benefits may:
be available only to eligible users;
be limited by time, location, stock, capacity or availability;
have separate provider or redemption conditions;
be withdrawn, replaced, paused or amended;
be non-transferable and have no cash value; and
be subject to reasonable fair-use limits.
Fair use includes using a benefit personally and honestly, following its stated conditions, avoiding duplicate or excessive claims, and not exploiting an error, loophole or technical fault.
Myle may refuse, cancel or recover a benefit obtained through error, duplicate use, misrepresentation, manipulation, abuse or breach of its applicable conditions. Myle will not retrospectively remove a benefit already validly earned or redeemed unless there is a legitimate reason, such as fraud, mistake or breach of the relevant terms.
The availability or withdrawal of a discretionary benefit does not alter rates, fees or other rights governed by a separate agreement.
13. Rewards, prize draws and promotional mechanisms
Any reward, spin-to-win feature, instant-win mechanism, competition, prize draw or referral promotion may be governed by separate rules shown before participation. Those rules may address eligibility, entry limits, dates, prizes, odds or allocation method, winner verification, fulfilment and circumstances in which an entry or award may be rejected.
Participation is not guaranteed merely because a feature is visible. Unless the specific rules state otherwise:
entry is limited to eligible current drivers;
participation is voluntary and no purchase is required;
entries and rewards are personal and non-transferable;
manipulation, automated entry, duplicate accounts, collusion or exploitation of an error is prohibited;
a displayed result remains subject to eligibility and technical verification; and
Myle may withhold or cancel an award where there is reasonable evidence of fraud, abuse, ineligibility or material technical error.
Myle will administer promotions fairly and in accordance with the published rules. Outcomes represented as random will not be deliberately changed to favour or disadvantage a particular participant. Significant eligibility restrictions and other material conditions will be made available before participation.
A specific promotion will not be cancelled or materially changed after it begins except where reasonably necessary because of circumstances outside Myle’s control, a legal or regulatory requirement, fraud, security risk or a material technical failure. Any change will be communicated appropriately and administered as fairly as reasonably possible.
14. Information use and sharing
Use of personal information is governed by the Privacy Notice, which should be read alongside these Terms. The Cookies and App Storage Notice explains how the App uses device and browser storage.
Information submitted to or generated through the App may be accessed and used by appropriately authorised personnel for legitimate operational, administrative, compliance, safety, security and service purposes.
Sharing with TL Vehicles Ltd
Myle may share App information with TL Vehicles Ltd, company number SC816034, the vehicle-rental arm associated with Myle, where the information is reasonably relevant to the activities, responsibilities or legitimate interests of either company.
This may include information relevant to:
vehicle rental and allocation;
driver or vehicle eligibility;
licensing, insurance and compliance;
vehicle condition, inspections, photographs, maintenance or recovery;
accidents, incidents, claims or damage;
rental charges, deposits, excesses, deductions or payment queries;
fraud prevention, account security, complaints or dispute resolution; and
the administration of services involving both companies.
Sharing will remain subject to applicable data-protection and confidentiality requirements. Information should be limited to what is reasonably necessary and relevant for the purpose. Myle and TL Vehicles Ltd remain separate legal entities, and sharing information does not transfer contractual responsibility from one company to the other.
Sharing with authorities and other organisations
Myle may preserve, use or disclose relevant information to a court, tribunal, police force, licensing authority, local authority, regulator, tax authority, insurer, emergency service, safeguarding body or other competent organisation where Myle reasonably believes that disclosure is:
required by law, court order or a lawful request;
necessary and proportionate for the prevention, detection or investigation of crime, fraud or unlawful conduct;
necessary to protect the safety, rights or property of a user, passenger, child, vulnerable person, Myle, TL Vehicles Ltd or another person;
relevant to licensing, insurance, contractual compliance, an accident or a legal claim; or
otherwise permitted under applicable law.
These Terms do not authorise indiscriminate disclosure. Each disclosure must have an appropriate basis and should be limited to information reasonably necessary for the relevant purpose.
15. Acceptable use
You must use the App lawfully, professionally and respectfully.
You must not:
impersonate another person or misrepresent your identity or authority;
harass, threaten, abuse or discriminate against another person;
use the App to commit, encourage or conceal unlawful activity;
upload false or misleading information;
probe, scan or test the vulnerability of the App without written permission;
reverse-engineer, copy, scrape or extract the App or its data except where the law expressly permits it;
introduce malware or interfere with the App’s operation;
access information or functions beyond your authorised role;
disclose confidential information obtained through the App without authority;
use another person’s personal information for an unrelated purpose;
manipulate benefits, referrals, rewards, entries, outcomes or usage records; or
use the App in a way that could damage Myle, TL Vehicles Ltd, users, passengers, customers, service providers or the public.
Users must report suspected misuse or security weaknesses privately to Myle and must not exploit or publicise them in a way that creates additional risk.
16. User content and permissions
You retain any rights you hold in content you submit. You give Myle a non-exclusive permission to host, copy, review, process, adapt for technical purposes, transmit and share that content to the extent reasonably necessary to:
operate the App;
administer your relationship with Myle;
provide a requested service;
work with TL Vehicles Ltd where relevant;
verify compliance or investigate an issue;
meet legal, regulatory, insurance or safety obligations; or
establish, exercise or defend legal rights.
This permission ends when the content is no longer required, subject to legitimate retention requirements described in the Privacy Notice and applicable law.
17. Intellectual property
The App, its design, software, branding, graphics, text and other materials supplied by Myle are owned by or licensed to Myle and are protected by intellectual-property law.
Myle grants authorised users a limited, personal, revocable, non-exclusive and non-transferable right to use the App for its intended purpose while their access remains active.
No ownership rights are transferred to the user. Myle names, logos and branding must not be copied, altered or used without written permission, except where the law allows.
18. Third-party services and links
The App may rely on or link to third-party services, including hosting, document-management, cloud-storage, communications, mapping, payment, identity, notification or business-management providers.
Those services may have their own terms and privacy information. Myle is not responsible for an unrelated third-party website or service merely because the App links to or integrates with it. This does not affect any responsibility Myle has for selecting and managing processors or service providers under applicable law.
19. Suspension and withdrawal of access
Myle may restrict, suspend or withdraw an account, feature or permission immediately and, so far as permitted by law, at any time. Reasons may include:
breach or suspected breach of these Terms or another applicable agreement or policy;
security, privacy, fraud, misuse or safeguarding concerns;
failure to complete verification or provide required information;
repeated or unreasonable failure to engage with relevant App processes;
inactivity;
a change in role, duties, approval or eligibility;
the driver or staff relationship ending or being suspended;
legal, licensing, insurance, operational or technical requirements;
protection of Myle, TL Vehicles Ltd, another user or the public; or
another reasonable operational reason.
Myle may act without advance notice where it considers immediate action appropriate. Where reasonably practicable and lawful, Myle will provide notice of the restriction or withdrawal and sufficient information to allow the user to understand the general reason. Myle may withhold details where disclosure could prejudice security, an investigation, another person’s rights or a legal obligation.
Suspension of App access does not automatically terminate or vary a separate contract, although the same circumstances may result in action under that contract.
Appeals
A user may ask Myle to review a suspension or withdrawal by emailing drivers@mymyle.com. The request should include the user’s name, relevant account details, the decision being challenged and any information the user wants Myle to consider.
Myle will review the matter within a reasonable period. The account may remain restricted while the review is completed. The outcome of the review does not prevent either party from exercising rights available under another agreement or applicable law.
20. Ending use of the App
You may stop using the App at any time. You may request closure of your App account using the contact details below, although Myle may retain information where required or permitted by law, for contractual administration, regulatory compliance, safety, fraud prevention, dispute resolution or legal claims.
Deleting the App or clearing device storage does not cancel a vehicle rental, driver agreement, payment obligation, open claim, compliance requirement or other separate arrangement.
When access ends, the right to use the App ends immediately. Provisions which by their nature should continue—including those concerning records, intellectual property, liability, governing law and lawful retention—will remain effective.
21. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation; or
any right or remedy that cannot lawfully be excluded or restricted.
Subject to the above, Myle is not responsible for loss caused by:
a user’s inaccurate, incomplete, late or unlawful submission;
failure to follow an applicable agreement, policy, procedure, legal duty or safety instruction;
use of an unsupported, insecure or incompatible device;
internet, mobile-network or third-party service failure outside Myle’s reasonable control;
reliance on a notification or provisional display without obtaining confirmation where the matter was urgent or material;
unauthorised account use resulting from a user’s failure to take reasonable security precautions; or
an event which Myle could not reasonably have prevented.
Myle is not liable for indirect or consequential business loss, loss of anticipated profit, loss of opportunity or loss of goodwill arising from use or unavailability of the App, except where such liability cannot lawfully be excluded.
Any exclusion or limitation in these Terms applies only to the extent that it is fair, reasonable and enforceable in the circumstances. These Terms do not reduce any mandatory statutory rights.
22. Changes to the App or these Terms
Myle may update the App and these Terms to reflect changes in features, operations, security, providers, law or regulatory requirements.
The latest version will be made available within the App. Where a change is material, Myle will take reasonable steps to bring it to the attention of affected users before or when it takes effect. Users may be required to accept revised Terms before continuing to use the App.
A change will not retrospectively remove a right or benefit already validly earned unless this is permitted by the applicable specific terms and there is a legitimate reason for doing so.
23. General provisions
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect. The affected provision will apply to the greatest extent lawfully possible.
A delay by Myle in enforcing a provision does not amount to a waiver of its rights.
You may not transfer your App account or your rights under these Terms to another person. Myle may transfer its rights and responsibilities as part of a genuine business reorganisation, merger, transfer or sale, provided this does not unlawfully reduce the user’s rights.
These Terms do not give a person who is not a party to them a right to enforce them, except where applicable law provides otherwise.
24. Governing law and courts
These Terms and any non-contractual dispute arising from them are governed by the law of Scotland.
The Scottish courts will have jurisdiction, subject to any mandatory right a user has to bring proceedings in another court.
